What Adjustment of Status Is

Adjustment of status is the process of applying for a green card from inside the United States, using Form I-485, without returning to your home country for consular processing. It is available to many people who already have a basis for permanent residence and are physically present in the U.S.

Who Is Eligible

To adjust status, you generally need a qualifying basis, such as a family petition, an employer petition, asylum, or another approved category; a visa that is available to you; and you must be admissible and physically present in the United States. How you entered the country matters, so it is important to review your history with an attorney before filing.
